Rights and Responsibilities

Both the defendant and the co-signer have specific rights and responsibilities. Our bail bondsmen will go to great lengths to make sure that each one understands what their rights are as well as the responsibilities they must agree to if they choose to hire us to write a bail bond for them. Bail bonds are a constitutional right that every American citizen is guaranteed. According to the 8th Amendment, each citizen has the right to post bail and be allowed to go home until their court date as long as there are no extenuating circumstances that would prevent bail from being set. The defendant also has the right to bail that suits the crime. For example, if a person is charged with a misdemeanor traffic violation, their bail would be rather small compared to someone who has been arrested for murder and has a bail of over $1 million.

Along with the defendant's rights, they also have responsibilities that must be adhered to. If they are allowed to post bond and be released from jail early, they must agree to attend all scheduled court hearings as well as comply with any other stipulations put in place by the court. If they do not attend court or fail to comply in any way, they can be re-arrested and put back in jail. If this happens, their bond will be forfeited and the co-signer will be required to pay the total amount of the bail bond plus any other charges pressed by the court.

The co-signer also has rights and responsibilities. As stated before, if the defendant fails to appear in court and their bond is forfeited, the co-signer will be required to pay for the entire amount of the bail bond. If property was used to cover the bond, it will have to be sold and the proceeds used to pay for the bond and any additional charges incurred through its sale. If there are any monies left over, they will be returned to the co-signer after the case has been resolved.

The co-signer has several rights to protect them from potential loss. One is the right to have a defendant's bail revoked if they feel, in any way, that the defendant has no intention of honoring their part of the bail bond contract. If the defendant chooses to have the defendant's bond revoked, all they have to do is call the bail bond bondsman who wrote the application and posted the bond. They will take the necessary steps to revoke the bond and return the money to the co-signer.

When a bond is revoked, the first step is capturing and re-arresting the defendant. Once the defendant has been put back in jail, the bail bonds bondsman can go to the jail and request that the bond money be released back to the co-signer. Once the defendant has been taken back into custody, the rest of the process is fairly easy. It may take several days for the bonds to be released, but once the defendant has been returned to the jail and is in custody, the process will move much faster.
